There are three different types of protective orders in Virginia that can be issued in situations of domestic violence.
A preliminary injunction in Virginia can only be applied for by the alleged victim or applicant if there is a serious risk of injury to life, physical or mental health or personal injury to the victim.
The order will remain in force until a hearing is held to determine whether a final VA protective order is necessary. If the respondent has committed an act of violence against a family or a family member and an arrest warrant has been issued, a judge may issue an emergency protective order if there is a risk of abuse or if the accused is prohibited from contacting the applicant. The applicant may be granted the home that he/she was living in if the victim is unable to return to the home and the order states that he or she is at risk of abuse.
An emergency protective order in VA remains in force until a court can issue a provisional protective order. An opponent of a protective order may be prohibited from contacting the applicant, going to the place prohibited by the order, mistreating a family member or committing a crime. Violating a protective order is a serious crime punishable by a criminal conviction of up to five years in prison and / or a $10,000 fine. If convicted of violating a protective order, a person faces a maximum penalty of five to ten years in prison and a fine of $1,500 per violation.
