Federal Petty Offense Magistrate Court Alexandria
The petty offense docket in the Eastern District of Virginia, Alexandria Division, handles the smallest cases the federal system hears and produces consequences that are frequently out of proportion to their size. Traffic citations from the Pentagon reservation, Fort Belvoir, Marine Corps Base Quantico, the George Washington Memorial Parkway, and Washington Dulles International Airport all arrive there, along with charges from federal buildings, veterans facilities, and park land across Northern Virginia.
People come to this docket expecting something like a Virginia general district court. It is not that. The proceedings are governed by Federal Rule of Criminal Procedure 58, the judge is a United States magistrate judge, the prosecutor is a federal prosecutor, and the disposition is a federal record. The hearing itself is short, which misleads people into treating the preparation as optional.

ToggleWhat Reaches the Petty Offense Docket
Two things put a case here. The conduct occurred somewhere the United States exercises jurisdiction, and the charge is minor enough to be handled under the streamlined procedure Rule 58 provides.
The charging document is usually a federal violation notice issued by the officer at the scene rather than a complaint or an indictment. Many of these notices are processed through the Central Violations Bureau, the national center that handles federal citations, and the notice states the charge, the location, and whether an appearance is required.
The substance of the charge often comes from Virginia law. The Assimilative Crimes Act, 18 U.S.C. § 13, borrows the state offense definition where Congress has not legislated on the conduct, so a driver cited on an installation road faces the Virginia provision, prosecuted federally. In areas administered by the National Park Service, dedicated federal regulation applies instead, including 36 C.F.R. § 4.23 for operating a vehicle under the influence in park areas. Which authority the government is relying on should be identified from the face of the notice before anything else is decided.
The Initial Appearance
Rule 58 sets what the court does at the first appearance. The magistrate judge informs the defendant of the charge, of the right to retain counsel or to request appointed counsel, and of the right to remain silent, including a caution that anything said can be used against the defendant.
Where the offense permits it, the court also explains that the matter can be resolved by forfeiting collateral instead of proceeding. That option resembles paying a state ticket and is not the same thing, because the disposition can be recorded as a conviction of a federal offense.
For a charge that is a misdemeanor rather than a petty offense, the court additionally advises the defendant of the right to be tried before a district judge, and the case proceeds before the magistrate judge only if the defendant consents. Whether to consent is a real strategic decision. It is presented briefly, often in a crowded courtroom, and it should be made with counsel rather than on the spot.
Trial, and the Question of a Jury
Petty offense matters are tried to the court rather than to a jury. Whether a particular charge carries a jury right turns on the maximum punishment the charged provision authorizes and on how the offense is classified, which is why the classification is worth confirming against the current text of the charging provision with counsel rather than assuming it from the citation.
The trial itself is a bench trial on a compressed schedule. The government calls the citing officer, introduces whatever measurement or observation evidence it has, and rests. Cross examination is the whole of the defense case in many of these matters, which puts the weight on preparation done beforehand: calibration and maintenance records for any instrument, the officer’s training and certification, the conditions under which an observation was made, and the record of exactly where the conduct occurred.
Motions exist here too. A stop made without a lawful basis, or a search that went beyond what the circumstances allowed, is a defect regardless of how small the charge is. The compressed schedule means those issues have to be identified early, because there is rarely a second setting in which to develop them.
Disposition, Record, and What Follows
Sentencing under Rule 58 is streamlined. The court may impose sentence without the full presentence process used in felony cases, so the argument for a particular outcome is generally made once and briefly.
The record is the part that lasts. A federal conviction, even for a traffic matter, sits in federal databases and appears on background investigations that ask about federal charges specifically. Clearance holders, commercial drivers, licensed professionals, federal employees and contractors, and anyone whose immigration status depends on a clean record should evaluate the disposition against those consequences before agreeing to it.
Review is available. A judgment entered by a magistrate judge is reviewed by a district judge of the same court, on the record made below rather than by way of a new trial. That difference matters, because it means the record built at the first hearing is the record the reviewing judge reads.
Frequently Asked Questions
Do I have to appear, or can I pay the notice?
The violation notice says which. Some notices allow collateral forfeiture instead of an appearance and others require one. Failing to appear when the notice requires it creates a separate problem, and paying when you should have contested creates a record you may not want.
Is this a criminal case?
Yes. A federal petty offense is a criminal matter prosecuted by the United States, and the disposition can be recorded as a criminal conviction. The informality of the docket does not change that.
Will I get a jury?
Petty offense matters are tried to the court. Whether a jury right attaches to a particular charge depends on the punishment the charged provision authorizes, so it should be confirmed against the current text of that provision with counsel.
Can I bring a lawyer to the Alexandria docket?
Yes, and the court advises defendants of the right to counsel at the initial appearance. Retaining counsel before that appearance is generally more useful than after, because the decisions that shape the case are made early.
What if I live out of state?
Many people cited on federal property in Virginia do not live in Virginia. Counsel can address scheduling and, depending on the charge and the court’s practice, may be able to reduce the number of appearances required. Ignoring the notice because of distance is the one approach that reliably makes matters worse.
Does a conviction here show up on a background check?
It can, and it is a federal record rather than a Virginia one. That distinction matters most for security clearance reporting, federal employment, professional licensing, commercial driving qualification, and immigration filings.
