National Park Service Citation Virginia Lawyer
A citation issued by a park ranger or by the United States Park Police in Virginia is a federal charge. It does not go to a Virginia general district court. It goes to the United States District Court for the Eastern District of Virginia, where a magistrate judge handles it under Federal Rule of Criminal Procedure 58. Virginia holds a great deal of Park Service land, and the George Washington Memorial Parkway alone produces a steady volume of these cases.
The citation looks minor and the paperwork encourages that impression. What it actually produces, if paid or resolved without thought, is a federal conviction that surfaces on background investigations, clearance paperwork, and commercial driving records. Law Offices Of SRIS, P.C. represents people cited on Park Service land in Virginia. Call (888) 437-7747 to discuss a park citation.

ToggleWhere Park Service Regulations Apply
Park Service regulations govern in areas the Park Service administers, and only there. In Virginia that includes the parkways, the battlefields, the historical parks, the recreation areas, and the national park land in the western part of the state.
It does not include military installations, Washington Dulles International Airport, veterans hospitals, or Arlington National Cemetery. Those are federal property administered by other agencies under other bodies of law. A citation issued at one of those places under a park regulation would be issued on an authority that does not reach the location, which is a defect in the charge rather than a formality.
What the Regulations Cover
The park regulations address conduct in park areas directly, including 36 C.F.R. § 4.23, which governs operating a vehicle under the influence of alcohol or drugs in those areas. Impaired driving charges from the George Washington Memorial Parkway are commonly brought under that provision rather than by borrowing the Virginia statute.
Where the regulations do not themselves cover the conduct, state traffic law is applied within the park area. Beyond driving, the regulations reach camping, fires, pets, closures, disorderly conduct, alcohol possession, and preservation of park resources. Which authority a given citation rests on is stated on the notice and should be read carefully, because the elements differ.
For conduct on federal land that no federal enactment covers, the Assimilative Crimes Act, 18 U.S.C. § 13, supplies the state offense definition and subjects the defendant to a like punishment in federal court.
How the Case Proceeds
Rule 58 governs. The magistrate judge states the charge at the initial appearance and advises the defendant of the right to counsel and the right to remain silent. Where the offense permits it, the court explains that the matter can be resolved by forfeiting collateral instead of appearing, and the amount is printed on the notice rather than fixed by this page.
For a misdemeanor that is not a petty offense, the defendant is advised of the right to trial before a district judge and must consent before the magistrate judge tries the case. Trials are bench trials on a short schedule, and sentencing may proceed without the full presentence process used in felony matters.
Defense Work and Consequences
Location is proof, not background. The government must establish that the conduct occurred within the park area, and boundaries along parkways and at trailheads are not always where visitors assume. Beyond that, the ordinary evidentiary questions apply: for a speed charge, the measuring device, its calibration record, and the operator’s training; for an impaired driving charge, the observations recorded, the instrument’s maintenance and certification history, and the handling of any sample. A stop without a lawful basis is a defect whatever the citation says.
The consequence that outlasts the case is the record. A federal disposition reaches security clearance reporting, federal employment, professional licensing, and immigration filings in ways a Virginia disposition may not. That is the reason to evaluate a park citation before paying it rather than afterward.
Frequently Asked Questions
Is a park ranger citation a real criminal charge?
It can be. Many park citations are federal petty offenses prosecuted by the United States, and the disposition can be recorded as a criminal conviction. The form it arrives on does not tell you how serious it is.
Which court hears it?
The United States District Court for the district covering the park area, before a magistrate judge under Federal Rule of Criminal Procedure 58. For Northern Virginia park land that is the Eastern District of Virginia, Alexandria Division.
Can I just pay it?
Only if the notice offers collateral forfeiture rather than requiring an appearance, and only if the resulting record is one you can carry. Read the notice before deciding.
Does 36 C.F.R. § 4.23 apply on a military base?
No. Part 4 of Title 36 applies in areas administered by the National Park Service. Military installations, federal airports, and veterans facilities are governed by other authorities, and a charge citing a park regulation outside a park area is defective.
What if the Park Police stopped me off park land?
Then jurisdiction becomes a live issue worth investigating. Where the conduct occurred is an element the government has to establish, and parkway boundaries and adjoining roads are a recurring source of dispute.
Will this appear on a background check?
A federal conviction sits in federal records and surfaces on investigations that ask about federal charges. Clearance holders, federal employees, contractors, commercial drivers, and non-citizens should weigh that before resolving the citation.
